The bill provides that interest on an order of restitution does not accrue while the defendant is:
- In the custody of the department of corrections within the state; or
- Under 16 year of age; or
- In noncertified kinship care or the custody of the division of youth services.
For orders of restitution entered prior to 2016, interest accrues at the rate of 12%. The bill authorizes a court to lower the rate to 8% on such orders.
(Note: This summary applies to the reengrossed version of this bill as introduced in the second house.)
