Sarah Cannon, Uniform
Law Commission (ULC), summarized the ULC review of the Colorado Bar Association
(CBA) proposed amendments. The committee had uniformity concerns with the
proposed changes to section 12 in the CBA draft.

Leia Ursery, CBA,
indicated that it was thought there may be ULC concerns with the CBA proposed
amendments because Colorado is unique in that it already has good infrastructure
with a medical decision-making proxy in place. |

Commissioner Snyder
shared that the feedback he has received from the Colorado Hospital Association
(CHA) and United Healthcare is that Colorado has a good system in place,
it's not perfect and could use some improvements, but they are not ready
to adopt this act for Colorado. |

As the commission
discussed continuing work on the act, Commissioner Levy pointed out that
the CBA has already done a lot of work reviewing the act and proposing
amendments. Those amendments do not look like they will be considered uniform
and additional work is unlikely to change that. |

Ms. Cannon added
that, while it's ideal to use the uniform language, there are idiosyncrasies
in every state that need some adaption and it may be possible an amended
act leaving section 12 as is could still qualify for a substantially similar
credit should the bar association like to discuss this more with the ULC

Ms. Ursery indicated
that the CBA does not yet have an official position on the act. If there
is a willingness to work on this and if they are allowed the time there
may be a way to get things closer to uniformity or substantial compliance.

The commission agreed
to allow more time for CBA and ULC discussions on the proposed amendments
and also asked Ms. Cannon to keep everyone apprised of what is happening
with enactments in other states. |

Jason Hopfer, lobbyist
for the Colorado Hospital Association (CHA), stated that there are areas
of Colorado's healthcare decision-making framework where greater clarity
and modernization would benefit patients, families, and providers. However,
the CHA has serious concerns about adopting the uniform act at this time
and is opposed to moving forward with it. |

Commission consensus
was to have the CBA and CHA continue conversations and to lay this act
over to the 2027 legislative agenda. The commission thanked the CBA, CHA,
and other stakeholders for their work on the act.
