The committee returned
to order. Representatives Bird and Boesenecker, prime sponsors, presented
House Bill 25-1171, which adds motor vehicle theft in the first degree
to the list of offenses qualifying for the crime of possession of weapons
by a previous offender. Representative Bird explained the effect
of the bill and discussed its need. Representative Boesenecker further
discussed the merits of the legislation. Representative Boesenecker responded
to questions regarding restoration of the right to possess firearms under
the bill, and a forthcoming amendment. Discussion ensued regarding removal
of a weapon under the bill when the weapon was not used in an underlying
crime, and the scope of the bill in terms of population impacted. Discussion
followed regarding criminal sentencing under the bill, and the demographics
of the population that may be criminally charged under the bill. Representative
Boesenecker responded to questions regarding criminal charges available
under the bill, and the actions that would trigger criminal charges by
the bill. Discussion turned to a hypothetical fact pattern. |

representing Rocky Mountain Gun Owners, testified in opposition to the
bill. Mr. Andrew Sidley-MacKie, representing themself, testified in opposition
to the bill.
Mr. Sidley-MacKie
responded to questions regarding the circumstances under which a person
is charged with possession of a weapon by a previous offender (POWPO) crimes.
Mr. Valentinis and Mr. Sidley-MacKie responded to questions regarding sentences
for crimes that trigger a weapons possession ban under HB 25-1171.

in support of the bill. Chief Newbanks, representing the Colorado Association
of the Chiefs of Police, testified in support of the bill. Mr. Chief-Matthew
Packard, representing CDPS/Colorado State Patrol, testified in support
of the bill. Mr. Stan Hilkey, representing the Colorado Department of Public
Safety, testified in support of the bill. Jefferey Riester, representing
the Department of Law, testified in support of the bill. Carl Hamm, representing
Colorado Ceasefire, testified in support of the bill.
Discussion ensued
regarding the nexus between firearms possession and the crimes invoked
by HB 25-1171, and the rate at which firearms are a factor in automobile
thefts.
