Representative Phillips and Armagost, prime sponsors, presented House Bill 25-1142, concerning increasing the penalty for failure to exit premises.  The bill sponsors explained the effect of the bill and discussed its need.  Discussion ensued regarding what constitutes certain concepts under the bill, and how law enforcement would respond. Discussion followed regarding amendment L.002 (Attachment D) and concerns raised by stakeholders.

Committee members raised questions regarding whether the statute amended by HB 25-1142 has been used against protestors, and the potential for law enforcement to do so in the future. Further questions were asked regarding what happens when certain rights are violated. Discussion ensued regarding the stakeholder process, alternatives at the local level to HB 25-1142, and application to barricading in a home.
