Red Book Footnotes 2005

1.    Deleted by amendment.

2.    This section of House Bill 05-1086 shall not take effect until the department of health care policy and financing implements section 1 of House Bill 05-1086 and the executive director of the department of health care policy and financing files written notice with the revisor of statutes that section 1 of House Bill 05-1086 has been implemented.

3.    This act was passed without a safety clause. It shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution (August 10, 2005, if adjournment sine die is on May 11, 2005); except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.

4.    This provision is amended as it will become effective January 1, 2006.

16.    This provision was contained in an act that is referred to the people under referendum. It will be submitted to a vote of the people at the November 2005 election and will become effective upon the date of the Governor's proclamation if approved by the people.

17.    This section of House Bill 05-1317 shall take effect only if House Bill 05-1194 is enacted at the First Regular Session of the Sixty-fifth General Assembly, is approved by the people at the November 2005 statewide election, and becomes law.

18.    This section of Senate Bill 05-226 shall take effect only if House Bill 05-1001 is enacted at the First Regular Session of the Sixty-fifth General Assembly and becomes law.

19.    This act was passed without a safety clause. 30.    Section 40 of House Bill 05-1107 shall only take effect if Senate Bill 05-041 is enacted and becomes law. If Senate Bill 05-041 becomes law, section 40 of House Bill 05-1107 shall supersede section 42-3-211 (7) in section 2 of House Bill 05-1107 and shall take effect on the effective date of House Bill 05-1107.

40.    This section of Senate Bill 05-243 shall take effect upon adoption of the final rule, a decision by the governor to participate in a state petition process specified in the final rule, and the receipt of an implementing appropriation from the federal government in an amount deemed sufficient by the house of representatives agriculture, livestock, and natural resources committee and the senate agriculture, natural resources, and energy committee in consultation with the executive director of the department of natural resources to implement Senate Bill 05-243. The executive director shall notify the revisor of statutes in writing when these conditions have been satisfied.

41.    This section of Senate Bill 05-244 shall take effect upon passage only if Senate Bill 05-227 is enacted at the first regular session of the sixty-fifth general assembly and becomes law.

42.    This act shall take effect upon passage; except that Part XIV (4) of section 2 of this act shall take effect only if House Bill 05-1285 is not enacted at the First Regular Session of the Sixty-fifth General Assembly and does not become law, and section 13 of this act shall take effect only if House Bill 05-1285 is enacted at the First Regular Session of the Sixty-fifth General Assembly and becomes law.

43.    This section of House Bill 05-1053 shall take effect only if Senate Bill 05-052 is enacted at the First Regular Session of the Sixty-fifth General Assembly and becomes law.

44.    This section of House Bill 05-1013 shall only take effect if House Bill 05-1264 is enacted at the first regular session of the sixty-fifth general assembly and becomes law; and the estimated decrease in state cash fund revenues resulting from House Bill 05-1264, for the state fiscal year 2005-06, as reflected in the final fiscal impact statement prepared on House Bill 05-1264 by the legislative council staff, is equal to or greater than the estimated increase in state cash fund revenues resulting from House Bill 05-1013, if it takes effect, for the state fiscal year 2005-06, as reflected in the final fiscal impact statement prepared on this act by the legislative council staff; and the staff director of the joint budget committee files written notice with the revisor of statutes no later than July 15, 2005, that the aforementioned requirement has been met.

53.    This section will be renumbered on revision as 18-5-120 in the 2005 Colorado Revised Statutes.

54.    This section of House Bill 05-1161shall only take effect if House Bill 05-1243 and House Bill 05-1131 become law and the final fiscal estimate for House Bill 05-1243, as determined from the appropriations enacted in said bill, and the final fiscal estimate for House Bill 05-1131, as determined from the appropriations enacted in said bill, show an aggregate net reduction in the amount of general fund revenues appropriated for the state fiscal year 2005-06, that is equal to or greater than the amount of the general fund appropriations made for the implementation of this act for the state fiscal year 2005-06, as reflected in appropriation section of House Bill 05-1161, and the staff director of the joint budget committee files written notice with the revisor of statutes no later than July 15, 2005, that the aforementioned requirements have been met.

55.    This section of House Bill 05-1337 shall take effect January 1, 2006, only if House Bill 05-1266 is enacted at first regular session of the sixty-fifth general assembly and becomes law.
