Senator Gardner, chair, called the committee to order. Senator Cooke, prime sponsor, presented Senate Bill 17-189, concerning elimination of the requirement that a law enforcement agency is the only entity authorized to take fingerprints for purposes of a background check. Senator Cooke discussed legislation relating to fingerprinting requirements for certain occupations, and explained the bill. He responded to questions about the effect of the bill, and the authority of private fingerprinting services to access law enforcement records. Senator Cooke also responded to a question concerning the burden placed on law enforcement by fingerprinting requirements, and the responsibilities of private fingerprinting services.
11:01 AM -- Mr. Chris Andrist and Ms. Teresa Mucha, representing the Colorado Bureau of Investigation (CBI) within the Department of Public Safety, testified on the bill. Ms. Mucha explained the CBI process for conducting fingerprint-based background checks. Mr. Andrist responded to questions concerning the CBI's neutral position on the bill. Ms. Mucha responded to questions concerning taking fingerprints. Mr. Andrist discussed the process that may be used for receiving fingerprints taken by a private service. Senator Cooke clarified the existing process for submitting fingerprints to CBI. Ms. Mucha discussed vendors that could possibly submit fingerprints to CBI, and safeguards and rules that may be used in order to protect individuals' fingerprint information.
11:11 AM -- Mr. David Bradley, representing Denver Fingerprinting, testified in support of the bill. Mr. Bradley discussed the process for taking fingerprints. He responded to questions concerning data safeguards, technology used to capture fingerprints, and the cost of fingerprint services.
11:15 AM -- Ms. Peg Ackerman, representing the County Sheriffs of Colorado, testified in support of the bill. Ms. Ackerman discussed existing fingerprint requirements and pending legislation requiring certain professions to undergo fingerprinting.
