The committee returned to order. Senator Martinez Humenik, prime sponsor, presented Senate Bill 17-097, concerning the presumption that a conveyance of an interest in land also conveys an interest in adjoining property consisting of a vacated right-of-way. Senator Martinez Humenik explained the bill and discussed its need. She responded to questions about the bill.
01:54 PM -- Mr. Charles Calvin, representing the Colorado Bar Association, testified in support of the bill. Mr. Calvin explained what constitutes a vacated right-of-way, and the effect on documents that transfer of possession of property of claiming such right-of-ways. He discussed a forthcoming amendment. Mr. Calvin responded to questions concerning current practice of claiming vacated rights-of-way, and the effect of enacting the bill. Senator Martinez Humenik distributed amendment L.001 (Attachment A).

02:04 PM -- Mr. Paul Bacus, representing Professional Land Surveyors of Colorado, testified in support of the bill. Mr. Bacus explained a situation concerning a client who had property subject to an objection because there was no record of a transaction concerning a vacated alleyway. Mr. Bacus responded to questions concerning his client's situation.
