Representative Van Winkle, sponsor, introduced House Bill 16-1051. The bill requires the Department of Revenue (DOR) to create and provide a beneficiary designation form that allows a vehicle owner or joint vehicle owners to arrange a transfer of vehicle ownership to a named beneficiary upon the owner's or owners' death. Upon the death of the owner or last surviving joint owner, the beneficiary presents the notarized form, as well as proof of death and the auto title transfer fee to DOR to request a new title of vehicle ownership in his or her name. The transfer is not subject to the Colorado Probate Code. During the lifetime of the vehicle's owner, the signature or consent of the beneficiary is not required to sell the vehicle and the beneficiary designation can be changed or revoked at any time. Transferring the certificate of title to another person voids the beneficiary designation.

Brian Tobias, Department of Regulatory Agencies (DORA), and Duane Gall, Office of Legislative Legal Services, came to the table to explain the sunset review process.
Mr. Tobias continued with a more in depth discussion of how DORA approaches the sunset review process.
Mr. Tobias responded to questions from the committee about how often DORA has recommended that a program sunset.
Mr. Tobias discussed the specific sunset review of the Division of Professions and Occupations (DPO) within DORA. A copy of the sunset report can be found at: https://drive.google.com/file/d/0B8bNvcf083ydX1g5NU95S1pfaTQ/view. Mr. Tobias discussed the role and structure of DPO.

Mr. Tobias spoke specifically about the recommendation made by DORA during the sunset review process to schedule the Healthcare Professions Profile Program (HPPP) for its own sunset review in 2021, which is reflected in the draft bill (LLS 16-0441) being considered by the committee.
Mr. Tobias responded to questions from the committee regarding several topics related to DPO's sunset review, including the suggested sunset timeline for the HPPP.
02:06 PM -- Lauren Larson, Director of DPO, and Michael Skorupka, Deputy Director of DPO, came to the table to respond to questions from the committee regarding the HPPP and several other topics discussed in the sunset report.
02:21 PM -- Larry Sarner, Colorado Citizens for Science in Medicine, spoke to the committee about a series of concerns related to the healthcare areas that DPO regulates, the HPPP, and concerns with the sunset review of DPO that was conducted. Mr. Sarner provided the committee with a handout (Attachment A). Mr. Sarner also spoke about concerns with the draft bill related to the sunset report that the committee is considering.
