Senator Baumgardner, prime sponsor, presented Senate Bill 16-010. Under current law, a used off-highway vehicle (OHV) may not be sold to a powersports vehicle dealer if the owner does not possess a certificate of title for the vehicle. This bill allows a powersports vehicle dealer to purchase an OHV that has never been titled if it was previously purchased either in a jurisdiction that does not issue titles for such vehicles or in Colorado before January 1, 2014, if:

• the dealer contacts its local law enforcement agency to verify that the vehicle has not been reported stolen and its county clerk to verify there are no outstanding security interests on the vehicle; and

• the owner signs an affidavit, under penalty of perjury, to confirm ownership of the vehicle and how long the owner has possessed it.

The dealer must then present the signed affidavit to the Department of Revenue (DOR) to obtain a certificate of title for the OHV.



Current law allows an OHV registration issued by the Department of Natural Resources (DNR) to serve as sufficient evidence of ownership to obtain a title for the vehicle. The bill limits this to OHVs first purchased in Colorado before July 1, 2014, that have been registered for at least one year.

Senator Hodge, prime sponsor, presented Senate Bill 16-030. Under current law, individuals convicted of violating motor vehicle weight limits or the terms of overweight permits must pay a variable penalty and a surcharge, depending on the level of excess weight. This bill changes the variable surcharge rate to a flat 16 percent of the penalty for all violations. Senator Hodge distributed an example of a motor vehicle weight violation citation (Attachment A).

The committee returned to order. Senator Neville, prime sponsor, presented Senate Bill 16-011. The bill eliminates annual transfers of $15.0 million for transit projects from fee revenue imposed under the Funding Advancements for Surface Transportation and Economic Recovery Act of 2009 (FASTER). This includes a $10.0 million transfer to the Colorado Department of Transportation (CDOT) for transit related projects and $5.0 million for local transit projects. Eliminating the transfers increases the amount available for road safety projects by $10.0 million and increase the Highway Users Tax Fund allocation to counties by $2.75 million annually and the allocation to municipalities by $2.25 million annually.
