Jody Baker, Chair, Colorado Commission on the Aging (commission),
discussed the charge and activities of the commission and distributed a
handout (Attachment B).

Mindy Gates, Colorado Department of Human Services, announced that Steven Grund, appointee, resigned from the commission so he will not need to be confirmed.  Senator Ginal announced that Chad Federwitz and Ryan Burmood will be considered in absentia since they were not able to attend today's hearing, but were in attendance on March 12 when the confirmation hearing was initially scheduled.  Ms. Gates told the committee about Mr. Federwitz's and Mr. Burmood's professional background.

HB19-1246 - Amended, referred to the Committee of the Whole - Consent Calendar

Senator Cooke and Senator Moreno, bill sponsors, presented House Bill 19-1246.  Under the bill, the Colorado Municipal League (CML) may study the regulation of food trucks by local governments and meet with stakeholders to solicit input and recommendations on or before November 1, 2019.  CML may report to the General Assembly any findings, recommendations, or future legislative solutions.  The bill is repealed September 1, 2020.  Amendment L003 was distributed (Attachment D).

Senator Hisey, bill sponsor, presented House Bill 19-1274. The bill allows a Board of County Commissioners (BOCC) to delegate certain land use determinations to one or more county administrative officials. The following BOCC duties may be delegated as long as the delegation includes procedures for providing public notice and the submission of written comments:

  • subdivision improvement agreements; and
  • final plat, plat amendment, or plan correction review and approval.

The following duties may not be delegated:

  • any exception to, waiver, or deviation from a state or county subdivision of land requirement;
  • approval of any agreement to spend public funds; and
  • the waiver or restriction of any appeals process.

Senator Donovan, bill sponsor, presented Senate Bill 19-107. The bill allows an electric utility company or other electricity supplier to install or maintain above-ground broadband for internal and external use and for lease to a broadband internet service provider. In addition, if a broadband internet service provider has written authorization from an electric utility, the provider may enter into a contract with a private landowner to access an electric utility's easement on a landowner's private land if the provider is seeking access to construct or maintain above-ground broadband infrastructure, and the provider's access does not violate the easement's exclusivity term. An electric utility may not withhold written authorization from a broadband service provider and, if denying authorization, must notify the provider in writing of the reasons for the denial. An electric utility may be reimbursed for the actual and reasonable costs of sharing a landowner's easement with a broadband service provider. Finally, the Public Utilities Commission (PUC) may enforce violations of this section by both electric utility companies and broadband internet service providers.
