Senator Martinez Humenik, prime sponsor, presented Senate Bill 17-097, concerning the presumption that a conveyance of an interest in land also conveys an interest in adjoining property consisting of a vacated right-of-way. Senator Martinez Humenik explained the bill and discussed its need. She responded to questions about the bill.

Mr. Charles Calvin, representing the Colorado Bar Association, testified in support of the bill. Mr. Calvin explained what constitutes a vacated right-of-way, and the effect on documents that transfer of possession of property of claiming such right-of-ways. He discussed a forthcoming amendment. Mr. Calvin responded to questions concerning current practice of claiming vacated rights-of-way, and the effect of enacting the bill. Senator Martinez Humenik distributed amendment L.001 (Attachment A).

Mr. Paul Bacus, representing Professional Land Surveyors of Colorado, testified in support of the bill. Mr. Bacus explained a situation concerning a client who had property subject to an objection because there was no record of a transaction concerning a vacated alleyway. Mr. Bacus responded to questions concerning his client's situation.
