Esther van Mourik, Office of Legislative Legal Services, discussed a draft of potential committee legislation related to the Colorado Department of Agriculture's authority to acquire and dispose of real property. Committee members received a copy of the draft (Attachment A). Ms. van Mourik discussed how the bill grants the Commissioner of the department the authority to acquire and dispose of real property. She also discussed changes the bill makes to the Agriculture Management Fund. Ms. van Mourik and Commissioner Don Brown responded to a committee question regarding the department's intent to utilize the services of the Department of Personnel and Administration for future real estate transactions. Committee discussion ensued on the technical requirements of the bill and the committee's role in making recommendations for real estate transactions.

Committee discussion continued on whether the bill should specify that the committee's authority be in the form of an approval or a recommendation, as well as the timing for the department to submit transaction proposals to the committee. The bill will be introduced in the Senate with Senator Baumgardner and Representative Vigil as prime sponsors. All other committee members and Representative Esgar will be cosponsors.
