Representative Cutter called the meeting to order and reviewed the meeting agenda (Attachment A).  The following bills and corresponding fiscal notes were distributed to the committee members:

  • Bill 1 - Incentivize Development Recycling End Markets (Attachments B and C);
  • Bill 2 - Beverage Container Redemption & Refunds (Attachments D and E);
  • Bill 3 - Develop A Statewide Organics Management Plan (Attachments F and G); and
  • Bill 4 - CDPHE Increases Public Awareness Of Recycling (Attachments H and I).

Senator Priola distributed and explained Amendment #1 (Attachment J), which amends everything below the enacting clause, to Bill 1. Senator Priola answered questions about Amendment #1 to Bill 1. Committee discussion about Amendment #1 to Bill 1 ensued.

The committee discussed Section 4 of Amendment #1 to Bill 1. Senator Priola continued to respond to member questions about Amendment #1 to Bill 1.

Senator Moreno asked Richard Sweetman, Office of Legislative Legal Services, to give an overview of Bill 2. Senator Moreno provided additional comments about Bill 2.  Senator Moreno stated that he would not be making a motion to forward Bill 2 to Legislative Council.

Representative Cutter asked Jennifer Berman, Office of Legislative Legal Services, to give an overview of Bill 3.

Representative Arndt gave an overview of Bill 4.  She stated that Bill 4 was contingent on the adoption of Bill 2, which would make it moot if Bill 2 was not forwarded by the committee.  Richard Sweetman, Office of Legislative Legal Services, explained that Amendment #1 to Bill 1 incorporates provisions from Bill 4.

Randy Moorman, Eco-Cycle and Recycle Colorado, testified in support of Bill 1 and Amendment #1 to Bill 1. He discussed the membership of the Pollution Prevention Advisory Board. Mr. Moorman answered questions from the committee.

Dan Matsch, Eco-Cycle and Recycle Colorado, testified in support of Bill 3. He discussed the potential benefits of the bill. Mr. Matsch responded to comments from the committee.

Bree Dietly, American Beverage Association, testified on recycling policies. She provided two handouts to the committee (Attachments K and L). She provided information on producer responsibility systems and deposit return systems. Ms. Dietly answered questions from the committee.

Jon Etra, representing himself, testified in support of Bill 2. Senator Moreno made comments regarding Bill 2. Mr. Etra made additional comments about Bill 2.  Representative Cutter made comments regarding the legislative process.

Amanda King, Legislative Council Staff, clarified for the record that a majority of  the committee members, which is six, is needed to pass a bill out of the committee.  Senators Priola and Story requested to be co-prime sponsors of the bill, along with Representatives Cutter and Arndt.  It was determined that the bill would originate in the Senate.  The Office of Legislative Legal Services was given permission to make technical changes to the bill, if necessary.

Ms. Berman returned to the table to answer questions from the committee about Amendment #1 to Bill 3.
