The chair announced that Commissioners Fief and Roberts have resigned from the commission and replacement appointments will be forthcoming.



Discussion and Approval of Final Standards - Committee Discussion Only

Chair Baker began discussing new language for the standards concerning the rights of persons experiencing incarceration, specifically disability rights (Attachment A). The committee read and discussed the proposed standards.

Discussion of disability rights continued among the commissioners.

The commissioners
crafted the following motion:  Add language to the disability rights
standard to the effect that all accommodations must be reasonable with
consideration of the safety and security limitations of the facilities.
Additionally, add proposed changes from page 2 of Attachment A. Finally,
in the second bullet point, strike "actually" and substitute
"actively."

The commission discussed the proposed amendments to the disability rights standard at length.

The motion passed without objection.
10:54:05 AM  
Discussion moved to the standards related to Housing (Attachment B). Members of Subgroup 3 explained the changes made to the proposed standards since the commission's last meeting.

Add a footnote to the Housing standard that reads "Consistent with federal law, specifically the Americans with Disabilities Act of 1990 (ADA) and relevant guidance, construction after 2010 must comply with additional requirements as outlined in law."

The amendment passed without objection.

Approve the Housing standard as amended. The motion passed 13-0.
11:08:03 AM  
Adopt the Disability Rights standard, as amended. The motion passed 13-0.

a discussion of the enforcement of the standards, including the question
of which body will be responsibility for enforcement and granting variances.
 Commissioner Karbach raised concerns about the time spent on the
enforcement issue and discussed them at length.

Discussion turned to funding for implementation and enforcement.
