The committee was called to order. A quorum was present. Representative Lee, prime sponsor, presented Senate Bill 16-065, concerning criminal restitution. Representative Lee explained the effect of the bill and discussed its need. Representative Lee responded to questions regarding a provision in the bill pertaining to records expungement associated with restitution payment, and interest rates for restitution. Representative Lee responded to further questions regarding payment of restitution upon death of an offender. The following persons testified regarding SB 16-06

Ms. Christie Donner, representing the Colorado Criminal Justice Reform Coalition, testified in support of the bill. Ms. Donner addressed earlier questions regarding interest rates for restitution, and discussed the merits of the legislation. Ms. Donner responded to questions regarding tying interest rates for restitution to a market rate. Ms. Donner responded to further questions regarding a provision in the introduced version of the bill concerning revocation of a driver's license.

Mr. Paul Litschewski, representing the Judicial Department, made himself available to respond to questions regarding the bill. Mr. Litschewski addressed earlier questions about restitution payment upon death of an offender. Mr. Litschewski responded to questions regarding the population affected by the bill. Discussion ensued on this point. Discussion returned to a provision in the bill pertaining to records expungement. Discussion followed regarding the effect of amendment L.011 (Attachment A).

Ms. Hannah Proff, representing the Colorado Juvenile Defender Center, testified in support of the bill. Ms. Proff discussed restitution orders made against juveniles, and the financial hardships experienced by juveniles as a result. She explained how the bill would help in these situations, and the effect of juvenile restitution orders on parents and guardians. Ms. Proff discussed amendment L.011.
