Representative Arndt, prime sponsor, presented Senate Bill 17-046, which is intended to codify current practice with respect to the treatment of warrants and checks drawn on state funds that were not promptly presented for payment. It requires that the amounts held to pay warrants and checks be transferred to the Unclaimed Property Trust Fund if unpaid six months from the date of issuance. Representatives Pettersen and Exum, co-prime sponsors, presented House Bill 17-1002, which extends the existing tax credit for child care expenses made by low-income taxpayers for tax years 2017, 2018, and 2019. The tax credit is limited to qualifying taxpayers with a federal adjusted gross income of less than $25,000. The credit is equal to 25 percent of the taxpayer's child care expenses and is capped at a maximum amount of $500 for a single dependent or $1,000 for two or more dependents. Dependents must be under age 13. The tax credit is refundable, meaning the amount of the credit that exceeds the taxpayer's income tax liability must be refunded to the taxpayer. Representatives Pettersen and Exum addressed questions from the committee.

The committee returned to order. Representative Thurlow, prime sponsor, presented House Bill 17-1187, which refers a proposition to voters at the statewide election on November 7, 2017. Conditional on voter approval of the proposition, the bill changes the computation of the excess state revenues cap (Referendum C cap) for FY 2017-18 and all subsequent fiscal years. Under current law, the cap is grown annually by changes in the state's population and the Denver-Boulder-Greeley consumer price index. Beginning in FY 2017-18, the bill instead grows the cap annually by the average rate of annual change in state personal income for the five previous calendar years.



Committee members received a memorandum about TABOR, Revenue Changes, and the State Budget Situation, prepared by Legislative Council Staff (Attachment B) and a list of organizations that support HB 17-1187, provided by Representative Thurlow (Attachment C).

The offense does not apply to a primary caregiver, as defined in the state constitution, who advertises his or her services to prospective patients.
