Representative Kraft-Tharp, sponsor, introduced House Bill 16-1187. The bill creates sales and use tax exemptions for food and food packaging to be consumed by residents on the premises of a retirement community. The exemption encompasses both purchases and sales by a retirement community, provided that consumption of the food or food packaging is to occur on the community's premises. Specific provisions are included for the exemption of prepared food, including premade salads and sandwiches. Retirement communities to which the bill applies include:

      • assisted living residences;

      • nursing care facilities that provide services to people requiring continuous or regular inpatient nursing care; and

      • independent living facilities specifically serving as the primary residence for people age 55 and older.

Representative Court, sponsor, introduced House Bill 16-1297. The bill expands the number of voluntary contribution designations (or income tax check-offs) that may appear on a state individual income tax form from 15 to 20 check-offs. The bill also lowers the minimum amount of contributions that a checkoff program must receive in order to remain on the tax form from $75,000 to $50,000. Finally, the bill reestablishes the income tax check-offs that were excluded from the 2015 individual income tax form because they did not receive the minimum contribution in tax year 2014. The six programs that will be reestablished are:

      • The Colorado Healthy Rivers check-off program;

      • The Alzheimer's Association check-off program;

      • The Colorado Multiple Sclerosis check-off program;

      • The Colorado Cancer check-off program;

      • The Make-A-Wish Foundation check-off program, and

      • The Unwanted Horse Fund.



These check-offs would appear on the 2016 income tax form. Under the bill, these programs would not be treated as "first time programs." Each check-off program would have to receive $50,000 contribution amount in the first year and every following year to remain on the form. Each check-off program contains a repealer clause, effective January 1, 2021, unless the program is continued by the General Assembly. Representative Becker, K., sponsor, introduced House Bill 16-1286. The bill increases the percentage of the wildfire mitigation state income tax deduction from 50 percent to 100 percent of the costs incurred for performing wildfire mitigation on a taxpayer's property. The tax deduction cannot exceed $2,500 per income tax year or the total amount of the taxpayer's federal taxable income, whichever is less. The increased income tax deduction will be available for tax years 2017 through 2019. After that, the income tax reduction will return to 50 percent of qualified costs until tax year 2024, as specified in current law.

Representative Becker, K., sponsor, introduced House Bill 16-1266. Under current law, if test results indicate the presence of harmful contaminants in medical or retail marijuana, the licensee is required to quarantine the marijuana, notify the Marijuana Enforcement Division in DOR, and document and properly destroy the adulterated product. This bill allows the MED to quarantine, document, and destroy marijuana that tests positive for any substance determined by the Colorado Department of Public Health and Environment to be harmful, including unauthorized pesticides. Representative Becker distributed amendment L.001 (Attachment D), amendment L.002 (Attachment E), and amendment L.003 (Attachment F). Additionally, Representative Becker distributed several handouts to the committee (Attachment G and H, respectively).

Representative Garnett, sponsor, introduced House Bill 16-1301. The bill provides a state income tax credit to taxpayers that employ workers that are either preparing for or participating in a qualified pre-apprenticeship or an apprenticeship program. The credit is available for tax years 2018 through 2020 and is capped at $1 million per tax year and $3 million in total. An employer may receive up to $2,500 for each pre-apprentice and $5,000 for each apprentice. The credit is nonrefundable and may be carried forward for five years. The Colorado Department of Labor and Employment will issue, administer, and create the application requirements and guidelines for the income tax credit certificates. Representative Garnett, sponsor, introduced Senate Bill 16-121. The bill allows the governing board of a higher education institution or institutions to pledge up to 100 percent of tuition revenues, excluding any General Fund appropriations, when it issues bonds to pay the costs of a capital project. Institutions that participate in the Higher Education Revenue Bond Intercept Program are only allowed to pledge up to 10 percent of tuition revenues, which is the amount permitted in current law. A higher education institution is only permitted to issue bonds if it has been granted enterprise status. Representative Garnett distributed amendment L.003 (Attachment J).
