The bill allows an adult, 18 years of age or older, to establish a behavioral health order for scope of treatment (behavioral health orders) that communicates his or her behavioral health history, decisions, and preferences in the event that he or she later lacks decisional capacity to provide informed consent to, withdrawal from, or refuse behavioral health treatment. The bill aligns the new process for behavioral health orders with current advance medical orders for scope of treatment. The bill lists the requirements for behavioral health orders; details the duties and immunities for medical personnel treating an adult with a behavioral health order; details how a behavioral health order form may be executed, amended, or revoked; and specifies that executing or failing to execute a behavioral health order does not effect any health insurance contract, life insurance contract, or annuity. 02:10:36 PM Moe Keller, Mental Health Colorado, testified in support of the bill. 02:14:33 PM Evan Silverman, representing himself, testified in support of the bill and distributed a handout ( (Attachment A). 02:20:41 PM Alexandra Marie Salazar, Colorado Wellness Network, testified in support of the bill. 02:25:17 PM The witness panel responded to questions. 02:26:13 PM Jennifer Hill, representing herself, testified in support of the bill. 02:31:05 PM Dr. Lacey Berumen, National Alliance for Mental Illness, testified in support of the bill. This bill requires that all genetic counselors in Colorado be licensed by the Division of Professions and Occupations in the Department of Regulatory Agencies (DORA) by June 1, 2020. The bill sets forth the requirements for licensure, including that applicants be certified by certain national organizations, unless the applicant meets the criteria for a provisional license while obtaining the national certification. The bill also sets forth application and renewal processes, the scope of practice for genetic counselors, rulemaking authority, disciplinary procedures, and other provisions related to the establishment of the licensure program. Only licensed individuals may use the title of "genetic counselor" and other related titles. The licensure program is repealed on September 1, 2026, following a sunset review.
