Leora Joseph, Director
of the Office of Civil and Forensic Mental Health, Colorado Department
of Human Services gave a presentation to the commission on an update on
competency. Her presentation can be found here: (

The presentation gave an overview of the office's responsibilities including
mental health hospitals, forensic services, and mental health transitional
living homes. Ms. Joseph provided information about the office's budget
requests, the consent decree, competency, placement waiting lists, and
staffing issues.

Members of the commission made comments and asked a number of questions about the presentation about how the state can partner with counties.

The commission discussed Subgroup 1's proposed standards on Classification of Persons Experiencing Incarceration, topics 9 and 10. The commission decided to combine topics 9 and 10 into a single standard, which can be found here: https://app.box.com/file/1139466266964.

The commission voted
to amend topic 9 to read, in part, as follows:
  • People with disabilities
    shall be given equal access to work opportunities within the jail, and
    no one shall be denied opportunity to work on the basis of disability.
     Reasonable accommodations and modifications shall be made in order
    to allow people with disabilities to access employment and vocational opportunities
    in the jail.

When
making assignments for work release, including decisions about whether
a given person is assigned to work inside or outside of the detention facility,
jails may consider the following factors:

  • Outstanding criminal
    cases, criminal court trials, open warrants.

  • level and nature
    of any pending charges.
  • level and type
    of past or current convictions.
  • amount of bound.
  • custody level.
  • conduct and behavior
    while in facility.

Motion Amend the last bullet point of Topic 4 of Jail Staffing standards to say "When facilities do not have the ability to operate at adequate staffing levels over an extended period of time, they should conduct a staffing analysis in a manner that will allow the facility to meet the needs of their facility, the individuals experiencing incarceration, and the staff. Jails must also take all appropriate and available steps to remedy any staffing issues."
