Ron Kammerzell, Senior Director of Enforcement, Department of Revenue (DOR), and Katie Griego, Division Director of Employment and Benefits, Department of Human Services (DHS), reported on electronic benefit transfers (EBT). Three handouts were provided to the committee (Attachments A, B, and C). Mr. Kammerzell gave an overview of House Bill 15-1255, which requires DOR and DHS to adopt rules that relate to clients accessing public benefits at prohibited automatic teller machines (ATMs). He discussed collaboration with the DHS to design a system to identify the use of prohibited ATMs and establish a system of reporting. He explained efforts to prohibit and enforce the use of certain ATMs.

Ms. Griego listed the public benefits programs that DHS is responsible for and explained steps DHS has taken to prevent prohibited use of certain ATMs to access public benefits. Mr. Kammerzell gave details on the rule making process and described the outreach and education that DOR has utilized.

Ms. Griego explained how the county human services departments are educating cash recipient about prohibited use of ATMs. She noted that there is signage on prohibited ATMs. Ms. Griego and Mr. Kammerzell gave statistics on the use of prohibited ATMs. Mr. Kammerzell concluded by discussing future outreach and enforcement efforts on the issue.

01:51 PM -- Presentation by the CDPHE on the Zika virus



Dr. Jennifer House, State Public Health Veterinarian, Colorado Department of Public Health and Environment (CDPHE), presented on the Zika virus. She distributed a handout to the committee (Attachment D). She described the properties of the virus and where the virus has been detected. She talked about the outbreak and spread of the virus around the world.

Dr. House discussed the disease in the United States. She described the symptoms of the disease and the mosquito vector and where they are found in the U.S. She talked about the presence of the disease in Colorado.

Dr. House discussed the transmission of the virus, including fetal transmission, sexual transmission, and through blood transfusions. She noted that there is limited information on the Zika virus. She talked about the current scientific evidence regarding microcephaly.

Dr. House discussed the CDPHE's response and resources regarding the virus.

Dr. House responded to questions from the committee on microcephaly survival rate, similar viruses, and blood donations.

Representative Rosenthal, prime sponsor, presented House Bill 16-1316 to the committee. The bill amends the Colorado Children's Code to clarify the procedures for determining proper venue in dependency and neglect cases. The bill states that a child who is placed in the legal custody of a county department shall be deemed, for the entire period of the placement, to reside in the county in which the child's legal parent or guardian resides or is located.

Representative Primavera called the meeting back to order. Representative Willet and Representative Fields, co-prime sponsors, presented House Bill 16-1058 to the committee and distributed two handouts (Attachments E and F). The bill creates the crime of misuse of electronic images by a juvenile, a class 2 misdemeanor. The offense occurs when a juvenile knowingly distributes, displays, publishes, or possesses a sexually explicit image of himself or herself, or of another juvenile who is within four years of age of the offender. It is an affirmable defense to the crime if the juvenile did not solicit, request, make, transmit, or distribute the image, and he or she took reasonable steps to destroy or delete the image or report receiving the image to law enforcement or a school official.
