Senator Zenzinger, co-prime sponsor, explained SB 18-098, concerning amending a statutory provision relating to interest on damages that was ruled unconstitutional by the Colorado Supreme Court.  She explained the bill was generated from the Statutory Revision Committee in response to recent court rulings. 

Senator Zenzinger requested that the bill be laid over to address a subsequent court ruling that also impacts the bill.  She reported that the bill satisfied some equal protection concerns but not all of them and more time is needed to draft an appropriate amendment.

Ike Eckert, representing the Colorado Defense Lawyers Association, testified about the bill and the need for an all-encompassing amendment.  He further explained the bill and its attempts to align state statute with a Colorado Supreme Court decision regarding post-judgment interest.  He answered questions about pre and post judgment interest rates and the Supreme Court ruling.
