Representative Soper explained the effect of the bill and discussed its need, and Representative Bacon provided additional input on the bill.

Aaron Carpenter, Fiscal Analyst with the Office of Legislative Council Staff, and Jane Ritter, bill drafter with the Office of Legislative Legal Services, introduced themselves and expained their roles in the legislative process.  Mr. Carpenter responded to questions regarding the role of the memorandum that speaks to the elimination of a fiscal impact.

Representatives Sharbini and Joseph, prime sponsors, presented House Bill 23-1033, concerning persons with whom the Office of Alternate Defense Counsel may contact. Representative Sharbini explained the effect of the bill and discussed its need. Representative Joseph provided additional input on the merits of the bill. Representative Sharbini responded to questions regarding the population that is impacted by the bill, and the broadening of a term by the bill. Representative Sharbini responded to questions regarding the fees to be paid to contractors under the bill.

Representative Amabile, prime sponsor, presented House Bill 23-1012, concerning issues related to juvenile competency to proceed. Representative Amabile explained the effect of the bill and discussed its need.

Amanda Edwards, representing the Department of Human Services, testified on HB 23-1012 from an "amend" position. John Edwards, representing the Department of Human Services, testified on HB 23-1012 from an "amend" position. Tim Lane, representing the Colorado District Attorneys' Council, testified on the bill from an "amend" position. James Karbach, representing the Office of the State Public Defender, testified on the bill from an "amend" position. Discussion ensued regarding the positions of the witnesses should certain amendments pass. Mr. Karbach responded to questions regarding a section in the bill concerning waiver of privilege. Mr. Lane responded to questions regarding the ability of a court to call a second hearing for a juvenile in the absence of HB 23-1012. Mr. Lane and Mr. Karbach responded to questions regarding what triggers the transition of a juvenile to the adult criminal justice system.
