HB22-1063 - Amended, referred to House Appropriations

The committee was
called to order.  A quorum was present.  Representatives Amabile
and Benavidez, prime sponsors, presented House Bill 22-1063. The bill establishes
the Colorado Jail Standards Commission to establish statewide standards
for Colorado’s jails and requires the Department of Public Safety to enforce
these standards.   Representative Amabile explained the effect of
the bill and discussed its need.  Representative Benavidez provided
input on the merits of the bill.  Representative Amabile responded
to questions regarding the need for the legislation, and the fiscal impact
of the bill.  Representative Benavidez provided input on these issues.
 Representative Benavidez responded to questions regarding including
representatives of the faith community within the scope of the bill.

Colorado Counties, Inc., testified on the bill from an amend perspective.
 Ms. Pogue responded to questions regarding her organization's position
were certain amendments to pass.



Steve Reams, representing the County Sheriffs of Colorado, testified in
support of the bill.



Vincent Atchity, representing Mental Health Colorado, testified in support
of the bill.



Sheriff Reams responded to questions regarding the number of jails that
have or meet standards in Colorado, and his reasons for supporting the
bill.  Sheriff Reams responded to questions regarding the level of
support for the bill among County Sheriffs of Colorado members.

HB22-1082 - Amended, referred to House Appropriations

prime sponsor, presented House Bill 22-1082, concerning the enforcement
of state housing laws by the Department of Law, and, in connection therewith,
establishing a fair housing unit within the Department of Law.  Representative
Hooton explained the effect of the bill and discussed its need.  Representative
Hooton responded to questions regarding the parameters of the authority
granted to the Department of Law by the bill, and the fiscal impact of
the bill. Written testimony may be found in Attachment E.

support of the bill.



Ms.Hinchliff responded to questions regarding how her department will handle
the increased workload created by the bill, and the parameters of the authority
granted to the Department of Law by the bill.  Representative Hooton
provided input on the latter issue.  Discussion ensued regarding the
impact of amendments L.001 (Attachment F) and L.002 (Attachment G).

The committee returned to order. Representative Woodrow, prime sponsor, presented House Bill 22-1089, concerning a requirement that transportation network companies provide insurance to protect individuals from damages caused by uninsured motorists. Representative Woodrow explained the effect of the bill and discussed its need. Representative Woodrow responded to questions regarding how riders who hire a rideshare service might claim insurance when in an accident in the rideshare vehicle, and the minimum coverage required under the bill. Discussion ensued on this point.

may be found in Attachment H.  Brad Nail, representing Lyft, testified
in opposition to HB 22-1089.  Mr. Nail responded to questions regarding
other states that require the carriage of uninsured motorist coverage by
rideshare operators, and the types of insurance within the scope of the
bill.  Mr. Nail responded to further questions regarding model legislation
on the subject of insurance requirements for rideshare operators, and consumer
knowledge about insurance coverage when patronizing rideshares.  Mr.
Nail responded to questions regarding his earlier assertion that the bill
is unnecessary, and the number of rideshare operators in Colorado that
do not have motor vehicle insurance.  Discussion returned to Lyft's
principal objections to the bill.  Mr. Nail responded to questions
regarding the cost for various types of auto insurance.

Eric Faddis, representing the Colorado Trial Lawyers Association, testified in support of HB 22-1089.

Brian Fritts, representing himself, testified in support of the bill.

Mr. Faddis responded to questions regarding the ability of rideshare patrons to be covered for injuries by insurance carried by the rideshare operator or other party in an auto accident, and insurance levels required of rideshares in other states. Mr. Faddis addressed questions raised during earlier discussion about rideshare insurance coverage. Mr. Faddis responded to further questions regarding insurance coverage required of drivers in general, and the effect of certain language in HB 22-1089. Discussion returned to consumer knowledge about insurance coverage when employing a rideshare. Mr. Faddis responded to questions regarding his representation of Mr. Fritts in a lawsuit concerning lack of insurance in a rideshare accident.

Ms. Teglas responded to questions regarding auto insurance she carries. Discussion ensued regarding whether this helped to cover Ms. Teglas' injuries from a rideshare accident, and other potential insurance coverage sources with respect to this accident.
