Representative McCormick discussed a set of proposed stipulated facts that were provided by Representative Lindsay's attorney, Mr. Jerome DeHererra (Attachment A). The committee reviewed the document, and discussed each fact and possible changes to each fact. Representative Woodrow suggested that the committee amend stipulated fact 1 to be clear that the committee is still able to make judgements and findings about the fact. Mr. DeHerrera commented on the stipulations.

She discussed editing stipulated fact number 5 to include information about informal discussions or training regarding the role of caucus chair. The committee discussed adding language specifying that the facts as expressed do not limit the committee from making determinations of fault or obligation with regard to the fund. The committee discussed language related to staff support for caucus duties.

The committee discussed editing stipulated fact number 11 to include language regarding the ability of the committee to make arguments related to the described payment. Representative Woodrow suggested editing stipulated fact number 12 to include language specifying the Representative Joseph had asked about the transaction.

The committee discussed a stipulation of facts related to the payment of caucus dues and the fund balance of the caucus account, and discussed removing the stipulation from the document. Mr. DeHerrera commented.

The committee discussed stipulated fact number 19 and whether the language referenced one or two documents. The committee discussed adding language after stipulated numbers 20 and 21 stating that those facts accurately quote Mr. Quinn's report, but do not reflect the committee's conclusions regarding the accuracy or the completeness of the statements, which will be discussed at the hearing.
