Representative Luck,
prime sponsor, presented House Bill 25-1232. The bill makes property
owners liable for any harm suffered on their property when the person
was not allowed the means to protect themselves. Representative Luck explained
the effect of the bill and discussed its need. Representative Luck responded
to questions regarding what constitutes "harm" in the bill's
context, and the lack of repealing language in the bill. Discussion ensued
regarding certain scenarios that might be impacted by the bill, and what
constitutes a weapon under the bill. Discussion followed regarding the
scope of the bill in terms of sovereign immunity waiver.
