Discussion of Publication of Official Comments to Uniform State Laws - Vote to approve staff proposal

Thomas Morris, Managing Senior Attorney, Office of Legislative Legal Services, testified before the Committee. He discussed a proposal from the Colorado Commission on Uniform State Laws (CCUSL) to stop publishing the Uniform Law Commission's official comments in the Colorado Revised Statutes and instead include a cross reference  in statute to the official Comments on the Uniform Law Commission's website. Mr. Morris currently serves as the secretary of CCUSL.

Representative Willett and Mr. Morris discussed the different weight courts may give to official comments published in statute and official comments available on the Uniform Law Commission's website that would be cross-referenced in statute.

Jeremy Schupbach, Colorado Bar Association Director of Legislative Relations, testified before the Committee. He spoke to Representative Willett's question about the difference in judicial weight between published and online Uniform Law Commission official comments.

Senator Gardner discussed his support for including cross references to official comments on the Uniform Law Commission's website in statute instead of publishing the official comments in statute.

Jennifer Gilroy, Revisor of Statutes, testified before the Committee. She asked whether the Committee wanted to include Colorado Comments as well as Uniform Law Commission offical comments in the motion to approve the proposal.

Motion I move that the Committee on Legal Services direct the Revisor of Statutes to include in the Colorado Revised Statutes, following those sections of the uniform laws that have official comments prepared by the Uniform Law Commission, cross references that would refer readers to the Uniform Law Commission website where the official comments can be found and that we not publish the official comments with the Colorado Revised Statutes in a prospective fashion, and I would also amend the motion to include that Colorado comments will not be published.
