10:36 AM -- Briefing by the Joint Budget Committee pursuant to Joint Rule 25



Senator Gardner, chair, called the committee to order. The Joint Budget Committee (JBC) briefed the Joint Judiciary Committee on the FY 2017-18 budget outlook for the committees over which Judiciary has oversight. Committee members received the JBC FY 2017-18 Staff Budget Briefing Summary (available at: http://leg.colorado.gov/publications/fy-2017-18-staff-budget-briefing-summary) Senator Moreno introduced himself and provided an outline of the presentation, and Senator Lambert, JBC chair, introduced the JBC Staff. Senator Moreno began the presentation with an overview of the Department of Corrections (DOC) FY 17-18 budget, including an overview of JBC Staff-generated budget recommendations. Senator Lambert responded to questions from the committee concerning the DOC budget.

Senator Lambert, Senator Moreno, and Representative Young continued to respond to questions concerning the DOC budget, specifically concerning medication, sex offender treatment, and private prisons.

JBC members continued to respond to committee questions concerning private prisons, medical services programs, and sex offender treatment.

Senator Moreno continued the presentation with the Judicial Department's FY 17-18 budget outlook. Senator Lambert commented on the Office of the Child Protection Ombudsman's move to the Judicial Department, and on two statewide programs: Office of Respondent Parents' Counsel and the statewide discovery program.

Senator Moreno presented the Department of Law's FY 17-18 budget outlook, including staff recommendations and a brief overview of a proposed changing to the department's billing rules. Senator Lambert and Representative Hamner responded to a question concerning judicial decisions that affect budget decisions.

Senator Moreno presented the Department of Public Safety's FY 17-18 budget outlook. In response to the committee, Senator Mareno clarified a point concerning the public safety budget.





11:44 AM -- Presentation by the Office of Legislative Legal Services and fiscal notes staff



Mr. Michael Dohr, Office of Legislative Legal Services (OLLS), provided a brief overview of the functions of OLLS in the committee process.



Ms. Kerry White, Legislative Council Staff, discussed the role of fiscal notes in the committee process.

























11:49 AM -- Presentation by Alternate Defense Counsel pursuant to the SMART Government Act



Ms. Lindy Frolich, Director; Ms. Stacie Colling, Juvenile Defense Coordinator; and Mr. Daniel Nunez, Controller and Budget Manager; appeared before the committee on behalf of the Alternate Defense Counsel (ADC) pursuant to the SMART Government Act and legislative Joint Rule 25. The committee received a copy of ADC's annual report to the Joint Judiciary Committee (Attachment A). Ms. Frolich provided an overview of the function of ADC, including the effects of recent legislation. She explained the work that the ADC performs, and how the ADC is staffed. Ms. Frolich also discussed how the ADC is working within the new statewide e-discovery program and explained the role of social workers in adult programs.

Ms. Frolich continued to discuss ADC programs and initiatives, including providing access to legal research for contract attorneys on ADC cases. Ms. Colling discussed the effect of HB 14-1032, which led to the creation of a juvenile defense system within the ADC. Ms. Colling responded to a question concerning the caseload of the ADC and the State Public Defender's Office. Ms. Frolich commented on the caseload management and assignment. Ms. Colling responded to a question concerning the juvenile caseload of ADC.



Representative Lee, chair, opened the floor to public testimony. No witnesses came forward to testify.
