Discussion of Draft Standards -

Chair Baker introduced
the draft standard for reception and release, which can be viewed here:

Commissioners commented on the draft reception and release standard.  The commissioners discussed including a statement that best practices include allowing phone calls upon release and transportation resources.  The commission will vote on the final reception and release standards at next month's meeting.  Chair Baker noted that Subgroup 1 will next be working on restrictive housing standards.

the overlap between the discipline standards proposed by Subgroup 2 and
references to discipline and the use of force in the inmate prerogative
standards proposed by Subgroup 4.

Commissioner Demo
discussed the use of restrictive housing and previous discussions of the
commission the the topic. The commission discussed current state law regarding
restrictive housing. The commission discussed the possible interaction
between adopted standards on mental health and housing standards. The commission
continued to discuss the potential for conflicting language between the
standards. Commissioner Karbach discussed the possibility of the Subgroup
2 resolving any conflicts between the discipline standards and topic 17
of the health and mental health standards previously adopted by the commission.

The commission discussed the provisions of the grievance standards. Commissioner
Demo noted that most facilities have handbooks and kiosks that can provide
information. The commission discussed potential language around the time
period to respond to inmate grievances. Commissioner Baker discussed adding
language around accommodations.

discussed language regarding fire retardant blankets. The commission discussed
accessibility accommodations related to fire safety.

The commission
discussed changing the title of the standards to "Rights of Persons
Experiencing Incarceration". The commission discussed the potential
duplication between this set of standards and other subgroups' standards.
The commission discussed topic V and its reference to disability rights.
The commission discussed including a separate standard of disability rights
under the topic of rights of persons experiencing incarceration. Commissioner
Karbach discussed the overlap between previously adopted standards on communication
and topic IV.

The commission discussed
topic VI access to the media and whether there is a body of law on this
topic. The commission discussed topic VII and the potential overlap between
the standard and standards regarding recreation. The commission discussed
potentially distinguishing this standard from standards on educational
programming and whether the standard is necessary in light of this topic
being covered in other standards. The commission discussed whether there
is legislation that affects educational programming for persons aged 18-21
in jails. Chair Baker noted that topic VIII will be revised to focus primarily
on use of force.

Commissioner Brown and Commissioner Baker gave an update on the Enforcement Subgroup. The subgroup is focused on identifying an agency or group that can house an enforcement mechanism for the standards. Chair Baker discussed other states' efforts regarding jail standards. The commission will next meet on April 14, 2023.
